Retired Business Freedom Plan (20 September 2017) Terms and Conditions

    1. These specific terms and conditions apply to you if you were signed up to any Business Freedom Plan prior to 20 September 2017.  These terms and conditions apply in addition to our standard Business Terms and Conditions and the Business Account Terms and Conditions and will prevail in the event of any inconsistency between these terms and conditions and the Business Terms and Conditions or the Business Account Terms and Conditions.
    2. Capitalised terms not defined herein have the meaning given to them in the Business Terms and Conditions and the Business Account Terms and Conditions.
    3. The rates and conditions below apply when you use your Mobile Phone (or other device) in New Zealand only and have subscribed to a Business Freedom Plan.
    4. Prices stated include GST unless stated otherwise.
    5. If you are a customer who prior to 16 February 2015 signed up to a Freedom Term $39.95 Business Carryover Plan, then from 16 February 2015 (inclusive) your Carryover Plan has been replaced with a Plan of an equivalent price point (as set out in clause 6 below) and you are subject to these terms and conditions.
    6. Subject to these terms and conditions, each of your Team Members may sign up to the Business Freedom Plan, the Business Freedom Plus Plan, or the Business Freedom Ultimate Plan (Business Freedom Plans):

    • A Team Member may also sign up to a Business Link Plan in accordance with clauses 31 to 37.

    Minutes

    1. Unless otherwise stated in these terms and conditions, Minutes are only valid for voice calls to any standard landline or mobile in New Zealand and Australia.

    Carryover Minutes

    1. Carryover Minutes allocated under a Business Freedom Plan will be pro-rated up to the Billing Date following activation of that Business Freedom Plan, and thereafter will be allocated on each Billing Date.
    2. If you do not use your full allocation of Carryover Minutes during your Billing month, your unused Carryover Minutes for that Billing month will be carried over to the following Billing month. Carryover Minutes (if not used) can be accrued for up to 12 months and will expire on the day prior to the first anniversary of the Billing Date on which these minutes were first allocated to you. During any Billing month, your accrued Carryover Minutes (if any) will always be used before any new allocation of Carryover Minutes for that Billing month.
    3. If a Team Member consumes the Carryover Minutes of their Business Freedom Plan while they are on a call, you will be charged the standard per minute rate for the remainder of the call and for any subsequent calls in accordance with our Pay Monthly and Business Standard Rates Terms and Conditions until further Carryover Minutes are allocated on your next Billing Date.
    4. Carryover Minutes cannot be used to make calls to premium rate numbers (for example 0900, 018), voicemail or satellite phones.
    5. All calls are rounded up to the next whole minute.

    Unlimited Calls

    1. You will be charged a 0 cent per minute rate for all calls to any standard mobile or landline in New Zealand and Australia on each Billing Date for the term of your applicable Business Freedom Plan provided you pay the applicable Plan Charge.
    2. Unlimited Calls cannot be used to make calls to premium rate numbers (e.g. 018, 0900) or satellite phones.
    3. Our Fair Use Policy applies to Unlimited Calls. For the avoidance of doubt, Unlimited Calls must be person to person use consistent with our estimate of reasonable use of this service (referencing standard and/or estimated customer profiles). We may take action if we consider use to be in breach of the Fair Use Policy. Please ensure that you have read and understood our Fair Use Policy, which forms part of the Business Terms and Conditions and is published by us at 2degreesmobile.co.nz/fairusepolicy.

    NZ Data

    1. NZ Data can only be used in New Zealand.
    2. NZ Data allocation under a Business Freedom Plan will be pro-rated up to the Billing Date following activation of that Business Freedom Plan, and thereafter will be allocated on each Billing Date.
    3. If a Team Member does not use their full allocation of NZ Data during a Billing month, the Team Member’s unused NZ Data for that Billing month will be carried over to the following Billing month. For the purposes of these terms and conditions, this carry over NZ Data is referred to as “Carryover Data”. Carryover Data (if not used) can be accrued for up to 12 months and will expire on the day prior to the first anniversary of the Billing Date on which this NZ Data was first allocated. During any Billing month, the available Carryover Data (if any) will always be used before the NZ Data allocation for that Billing month.
    4. If a Team Members consumes all the NZ Data available under their Business Freedom Plan in any Billing month they will be required to purchase a Data Add On to be able to continue using data services until a new allocation of NZ Data is made under the Business Freedom Plan on your next Billing Date. You will be charged for any Data Add On purchased by a Team Member under their applicable Plan.
    5. Data usage per session is rounded up to the nearest 5.12KB increment. Minimum data usage per session of 20.48KB applies.

    Unlimited Text

    1. You will be charged at a 0 cent per text rate for all text messages sent to any standard mobile in New Zealand and Australia on each Billing Date for the term of your Business Freedom Plan provided you pay the applicable Plan Charge.
    2. Unlimited Text cannot be used for MMS or texts to premium rate numbers.
    3. Our Fair Use Policy applies to Unlimited Text. For the avoidance of doubt, Unlimited Text is only available for person to person use consistent with our estimate of reasonable use of this service (referencing standard and/or estimated customer profiles). We may take action if we consider your use to be in breach of the Fair Use Policy. Please ensure that you have read and understood our Fair Use Policy, which forms part of the Business Terms and Conditions and is published by us at 2degreesmobile.co.nz/fairusepolicy.

    Free Calling Group

    1. Zero rated calls can be made between Team Members under the same Business Account (Free Calling Group) provided that the Plan Benefit of those Team Members includes a voice entitlement (e.g. an allocation of Minutes). Free Calling Group is applied at a Business Account level only.
    2. For the avoidance of doubt, a Team Member’s Plan that is a Business Mobile Data Plan cannot be part of the Free Calling Group.
    3. Zero rated calling will not be available to a Team Member making calls to, or receiving calls from, another Team Member in the Free Calling Group, while the Team Member is roaming outside of New Zealand.
    4. We may suspend or bar your Free Calling Group if you have any outstanding Charges or any other overdue payment in respect of your Business Account.
    5. Our Fair Use Policy applies the Free Calling Group. We may take action if we consider use to be in breach of the Fair Use Policy. Please ensure that you have read and understood our Fair Use Policy, which forms part of the Business Terms and Conditions and is published by us at 2degreesmobile.co.nz/fairusepolicy.

    Free Voicemail Calling

    1. If the Business Freedom Plan under your Business Account includes Free Voicemail Calling, the Team Member belonging to that Business Freedom Plan can make zero rated calls to Voicemail.
    2. Where a Business Freedom Plan under your Business Account does not include Free Voicemail Calling, calls to Voicemail will be charged the standard rate for calls to Voicemail in accordance with our Pay Monthly and Business Standard Rates Terms and Conditions.

    Business Link Plan

    1. In order to have a Business Link Plan on your Business Account, you must activate that Business Link Plan to Team Share services by connecting it to an active and eligible Business Freedom Plus Plan (Team Share Plan), or other Business plan as advised by us from time to time.
    2. We will charge you $25 (incl. GST) each Billing month (or part month) for any Business Link Plan that is connected to a Team Share Plan under your Account for Team Share services.
    3. Our standard Team Share Terms and Conditions apply to the use of Team Share Services.
    4. You may have up to three (3) Business Link Plans connected to a Team Share Plan under your Business Account at any one time.
    5. We reserve the right to terminate any Business Link Plan under your Business Account that ceases to be connected to a Team Plan for Sharing services.
    6. You cannot activate a Business Link Plan on a 24 month term.
    7. A Business Link Plan does not include any minutes, text or data benefits. You will be charged our standard rates calling, texting or using data in New Zealand, international calling, and any rates that apply for overseas roaming. Our standard rates are published on our website at www.2degreesmobile.co.nz.

    Changing your Business Freedom Plan

    1. Unless stated otherwise, you can change a Business Freedom Plan to another Plan made available under your Business Account (New Plan) any time by calling Customer Care.
    2. We may refuse to change a Business Freedom Plan to a New Plan if you have not paid all of the outstanding Charges under your Business Account.
