Retired Business Carryover Plans/Share Everything Plans ETCs and PTCs

These charges apply to the Business Carryover Plans and Business Share Everything Plans on a fixed term or Freedom Term retired on 16 February 2015. 

  1. These specific terms and conditions apply in addition to the Pay Monthly Terms & Conditions, Business Account Terms & Conditions, and any other specific terms and conditions that may be applicable to a Plan under a Business Account (together, the Applicable Terms and Conditions).
  2. These specific terms and conditions will prevail in the case of inconsistency with the Applicable Terms and Conditions.
  3. Unless stated otherwise, words and phrases in these specific terms and conditions have the same meaning given to them in the Applicable Terms and Conditions.
  4. Early termination charges are not subject to GST.
  5. Plan transfer charges are subject to and inclusive of GST.

EARLY TERMINATION CHARGES

  1. Unless stated otherwise, we will require you to pay early termination charges where your Retired Business Carryover Plan or Retired Business Share Everything Plan on a fixed term is terminated either by you or us in accordance with the Applicable Terms and Conditions.
  2. For the avoidance of doubt a 12 month term may be applicable only to those Retired Business Carryover Plans and Retired Business Share Everything Plans activated prior to 3 April 2014.
  3. The amount of the early termination charge that you will be required to pay in respect of your terminated Retired Business Carryover Plan or Retired Business Share Everything Plan on a fixed term is calculated as follows:

The monthly Plan Charge (including GST) of your Retired Business Carryover Plan or Retired Business Share Everything Plan multiplied by the number of months remaining on the term of your Retired Business Carryover Plan or Retired Business Share Everything Plan as at your final Billing Date multiplied by 40%, provided that if this amount is less than the minimum amount stated in the table below you will be required to pay the minimum amount.

For example, if you terminate your $99.95 Business Share Everything Plan in the third month of a 24 month term, your early termination charge will be $839.58 (being $99.95 x 21 x 0.4).

However, if you terminate your $99.95 Business Share Everything Plan with five months remaining on your 24 month term, your early termination charge will be $210, being the early termination charge minimum amount stated in the table above (due to $99.95 X 5 X 0.4 = $199.90 being lower than the minimum amount stated).  

  1. For the avoidance of doubt, no early termination charge applies to the cancellation of a Retired Business Carryover Plan or Retired Business Share Everything Plan on a Freedom Term (or a month to month term).  

PLAN TRANSFER CHARGES

  1. You cannot transfer your Retired Business Carryover Plan or Retired Business Share Everything Plan on a fixed term or a Freedom Term to any other Retired Plan.
  2. You can transfer your fixed term (12 or 24 month term) Retired Business Carryover Plan or Retired Business Share Everything Plan to a fixed term Business Select Plan provided you pay the  following plan transfer charges:

Months into term: 0-6 months

If you are changing your Retired Business Carryover Plan or Retired Business Share Everything Plan to a Business Select Plan within 0-6 months of your fixed, your Plan transfer charge will be the amount stated in the table below:

For example, if you are changing your 24 month $69.95 Business Carryover Plan to a $35.83 Business Select Plan in the third month of your term you will pay a Plan transfer charge of $590.

Months into term: 7-12 months

If you are changing your Retired Business Carryover Plan or Retired Business Share Everything Plan to a Business Select Plan within 7-12 months of your fixed term, your Plan transfer charge will be the amount stated in the table above multiplied by 75%.

For example, if you are changing your 24 month $69.95 Business Carryover Plan to a $35.83 Business Select Plan in the ninth month of your term you will pay a Plan transfer charge of $442.50 (being $590 x 0.75).

Months into term: 13-18 months

If you are changing your Retired Business Carryover Plan or Retired Business Share Everything Plan to a Business Select Plan within 13-18 months of your fixed term, your Plan transfer charge will be the amount stated in the table above multiplied by 50%.

For example, if you are changing your 24 month $69.95 Business Carryover Plan to a $35.83 Business Select Plan in the 14th month of your term you will pay a Plan transfer charge of $295 (being $590 x 0.5).

Months into term: 19-24 months

If you are changing your Retired Business Carryover Plan or Retired Business Share Everything Plan to a Business Select Plan within 19-24 months of your fixed term, your Plan transfer charge will be the amount stated in the table above multiplied by 25%.

For example, if you are changing your 24 month $69.95 Business Carryover Plan to a $35.83 Business Select Plan in the 20th month of your term you will pay a Plan transfer charge of $147.50 (being $590 x 0.25).

  1. If you are on a Freedom Term Retired Business Carryover Plan or a Freedom Term Retired Business Share Everything Plan, you can transfer to another Plan or Service offered by 2degrees without paying any plan transfer charges or early termination charges.

GENERAL

  1. For the avoidance of doubt you are not able to transfer your fixed term Retired Business Carryover Plan or fixed term Retired Business Share Everything Plan:
    1. to another available Freedom Term Plan;
    2. to a Business Mobile Data Plan;
    3. to a Business Connect Plan; or
    4. to a Pay Monthly consumer Plan or Prepay.

    If you wish to do so, your current Plan will be terminated and you will be required to pay early termination charges in accordance with the terms and conditions of that Plan.
