2degrees Toll Free Terms and Conditions

  1. In the event you: 
    1. select a 0800/0508 toll free number (Number) made available to you by 2degrees; or
    2. port in your existing Number,

      for the purpose of allowing your customers (or other parties at your discretion) to call you at no charge, these specific terms and conditions (Toll Free Terms) apply in addition to the 2degrees Business Broadband Terms and Conditions, the 2degrees Business Phone Services Terms and Conditions, the 2degrees Business Broadband Plan Terms and Conditions and any other terms and conditions that apply to your Account with 2degrees. 
  2. In the case of inconsistency between these Toll Free Terms and the 2degrees Business Phone Services Terms and Conditions, the 2degrees Business Broadband Plan Terms and Conditions or any other terms and conditions that apply to your 2degrees Account, these Toll Free Terms will prevail. 
  3. Unless stated otherwise, capitalised terms have the same meaning given to them in the 2degrees Business Broadband Terms and Conditions.
  4. All rates set out in these terms exclude GST (unless stated otherwise), and are subject to change.

    Eligibility

  5. You must have a business landline or business mobile connection provided under a 2degrees business plan in order to be eligible for a toll free service.

    Term

  6. You may terminate your toll free service with 30 days’ notice by sending an email to biz.bbsupport@2degrees.nz or calling our 0800 number (0800 022 249). 
  7. We may terminate your toll free service with 30 days’ notice by sending an email to the email address agreed in your business plan. 
  8. You will remain responsible for all charges relating to the toll free service during the 30-day notice period.
  9. If you wish to retain your Number when you terminate a toll free service, you must tell us when you give notice to terminate under clause 6, otherwise we will release the number back to the Toll Free Number Administration Scheme (TNAS) pool.

    Requesting a New Number

  10. You may choose a new Number from those we offer to you or you may request 2degrees to check the availability of a specific toll free number.
  11. As there is a delay between requesting or booking a Number and its allocation, we cannot guarantee that your requested Number will be able to be provided to you until it is allocated.Porting Existing Numbers
  12. To port in an existing Number you will need to provide us with the existing Number, your account name and account number with your existing provider, your 2degrees account number and account name using a toll free request form, which you can request by sending an email to biz.bbsupport@2degrees.nz or calling our 0800 number (0800 022 249). 

    Charges

  13. Usage fees will be charged as follows:
    1. for a Number which has a simple configuration (meaning the Number is configured to connect to a single business mobile connection or a single business landline): 
      1. you will pay a fixed minimum monthly charge in arrears, as set out in clause 14 (Fixed Charge); and 
      2. further usage will be charged in arrears at the rates set out at clause 14 in addition to the Fixed Charge. These additional charges are incurred for each type of call made to the Number on a minute plus second basis (calculated to the next second) as set out in the table in clause 14 below; or
    2. for a Number which has a complex configuration (meaning the Number is configured to connect, for example, to different numbers depending on the originating geographic location of the call and/or the time the call is made), the charges applicable for a Number which has a simple configuration as per clause (a) above plus the additional monthly and installation costs applicable to a complex configuration set out in clause 14 will apply.
  14. The complete list of charges (in NZ$ and excluding GST) relating to the toll free service and each additional feature is set out below:

    For calls of 1 minute or less originating from:

    • Local and National Landline Numbers: $0.04;
    • Mobile Numbers: $0.21; and
    • Payphones: $0.33,

    provided that all calls which terminate on a Mobile Number will be charged at a rate of $0.40 per minute.

    Any usage over a minute will be charged on a ‘per second’ basis (by dividing the relevant ‘per minute’ charge above by 60).

  15. We may vary the charges in our sole discretion by giving you at least 7 days’ notice.

    Configuration

  16. A simple configuration will take a minimum of 4 Working Days to set up and a complex configuration will take a maximum of 10 Working Days. Any features required as part of a complex configuration will be agreed with you as set out in a Toll Free Service Form. We will work with you to confirm that the Number is configured correctly.

    Toll Free Number Administration Scheme (TNAS)

  17. Upon termination of your toll free service, we are required by the terms and conditions of the TNAS General Terms and Conditions (created by the NZ Telecommunications Forum Inc.) to return the Number to the pool of Numbers operated by TNAS. The Number may then be reallocated, if available, to any other service provider (including 2degrees) on a first-come first-serve basis.

  18. Subject to the pending transfer of a Number to third party purchasers of your business, or as otherwise may be approved by the TNAS, we may de-allocate any number and return it to the TNAS pool of numbers if no calls are recorded against it for three consecutive billing periods.

    Acknowledgements

  19. You acknowledge that:

    1.  we have no ownership rights in any Number or numbering scheme;
    2. you are not conferred ownership rights in a Number if it is allocated to you;
    3. we, and other telecommunications providers, have equal access to available Numbers on a first-come, first-served basis;
    4. before the Number may be allocated to you, a billing relationship must be established between you and 2degrees;
    5. If your Number is classified as “Unavailable” by TNAS, we will inform you of this and assist you to immediately take all appropriate steps to relinquish the Number and to arrange a replacement Number;
    6. you will ensure that, to the best of your abilities, the use of your Number and your use of any toll free services provided to you will not cause interference with any other toll free services or other users of toll free services;
    7. faults may arise as a result of TNAS’ conduct or error and we will not be responsible for any loss or damage you may suffer which arise from faults relating to TNAS’ system or delays in responding to or resolving faults caused by TNAS or relating to TNAS’ system; and
    8. in the event TNAS notifies us of any planned outages relating to TNAS’ system which will impact on your allocation of a Number or use of the toll free services, we will provide you with reasonable notice of such planned outages.
